Information for consumers regarding distance contracts as well as customer information for contracts within e-commerce.
§ 1 Area of validity
For business relations between us and the purchaser the following terms and conditions apply for orders placed via the web shop, according to the version that is valid on the day of the order.
§ 2 Contract conclusion
The display of our products at our internet presence only contains an invitation for the customer for submitting an offer. With placing an order the customer submits an offer according to § 145 German Civil Code. The customer receives an acknowledgement regarding the receipt of the order via E-Mail. A contract with us is concluded if we accept the customer's order in written or textual form within 2 business days after sending the order. Therefore the time the customer receives the declaration of acceptance is relevant. A business day is any day that is not a Sunday or a German legal holiday.
§ 3 Delivery, shipping costs
The delivery is executed always corresponding to the shipping costs shown in the individual case. Shipping times are based on our experiences and can't be guaranteed. We do our best to make the shortest delivery times possible but because of customs authorities or your local courier company, in very exceptional cases delivery time might take longer.
In the rare case of your package is delayed or lost, please note that we will have to contact the carrier to start an investigation. It may takes up to 20 days to complete the investigation. Once we have the claim confirmation from the carrier, we will gladly issue you a refund.
Unfortunately, packages are sometimes damaged during their journey, but unless your sealed package of formula was accidentally opened as well, damage to the box is only cosmetic.
If you received a badly damaged package, its necessary report it to the delivery man and take pictures of the damage. Otherwise the delivery organizations will deny a compensation. Please also don't hesitate to contact us and report the damage. We will then take care of it as quickly as possible.
There is an extremely low chance that customs charge extra fees. Anyway, customs policies vary widely from country to country. Orders shipped outside of the EU may be subject to import taxes, customs duties and fees. You may also be required to provide an identification number. Any resulting costs are for the customer.
§ 4 Reservation of proprietary rights
The delivered goods maintain our property until the completed payment of the purchase price.
§ 5 Payments
Only those payment methods are accepted which have been displayed to the customer during ordering process.
§ 6 Warranty
The German legal rights on warranty subsist.

We save your full name, your adress and in certain circumstances your phone number just to ensure a smooth shipping. If you want to delete your personally identifiable information, please contact us by mail.
§ 9 Consulting
Mother's milk is the best nourishment for your baby. Therefore, WHO recommend exclusive breastfeeding for the first six months and then continued breastfeeding together with a suitable and balanced supplement according to your baby's age. Consult a healthcare specialist (paediatrician, mother's advice, midwife) if your child needs a food supplement or if you no longer want to breastfeed.
Unless expressly indicated otherwise, Organic Baby Food GmbH (maluma-green.com) is not the manufacturer of the products sold on this site. Actual product packaging and materials may contain more and different information than what is shown on our website. We recommend that you do not rely solely on the information presented on our website. Please always read labels, warnings, and directions provided with the product before using or consuming the product.
§ 10 Right to cancel
You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquired, physical possession of the last good.
The right to cancel does not apply to the following kind of contracts:
- Contracts for the supply of goods which are liable to deteriorate or expire rapidly.
- Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.
§ 11 Effects of cancellation
If you cancel this contract, we will refund you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
§ 12 Coupon codes
In the case of a multiple-item order, the value of the coupon is allocated to each item based on the proportion of the item’s value to the total value of all items, excluding shipping, taxes and other charges. A coupon cannot be used to pay for taxes, shipping and handling or other charges. All coupons have a minimum purchase from $98, taxes, shipping and handling and other charges do not apply towards the minimum purchase amount. Coupons can not be combined with other offers in the same order. Generally, only one coupon code may be used per order.
